Thanks for using our service.
Cabbooks provides bookkeeping and Making Tax Digital for Income Tax software for self-employed taxi drivers.
If you browse our website or use our service, you agree to comply with and be bound by these terms. These terms are binding on any use of the service and apply to you from the time Cabbooks provides you with access to it.
These terms are not intended to answer every question or address every issue raised by using the service. It is your responsibility to make sure you have read, understood and agree to the most recent terms.
By registering to use the service, you confirm you have read and understood these terms and have the authority to act on behalf of any business for which you use the service.
Cabbooks may change these terms at any time by updating this page, and you agree to be bound by such changes. You should check this page regularly for the current terms that apply to you.
Definitions
“Cabbooks” means Cabbooks Limited, a company registered in England and Wales with company number 17360173.
“Data” means any data input or imported by you into the Service.
“Intellectual Property Rights” means any registered or unregistered design rights, patents, copyright, database rights, data protection rights, trademarks, service marks, moral rights, know-how and any other intellectual or industrial property rights, anywhere in the world.
“Service” means the bookkeeping and Making Tax Digital for Income Tax software made available (as may be changed or updated from time to time by Cabbooks) via the Website and any associated mobile app.
“Subscriber” means the person who registers to use the Service.
“Subscription Fee” means any fee payable by you in accordance with the pricing set out on the Website (which Cabbooks may change from time to time) in order to access the Service.
“Terms” means these Terms and Conditions of Use.
“Website” means cabbooks.online and any other website operated by Cabbooks.
“You” means the Subscriber. “Your” has a corresponding meaning.
Access conditions
Cabbooks grants you the right to access and use the Website and Service for as long as you continue to pay the Subscription Fee (if any), until your Subscription is terminated. This right is non-exclusive and non-transferable and is limited by and subject to these Terms. You must only use the Website and Service for your own lawful business purposes.
You will ensure that all usernames and passwords required to access the Website are kept secure and confidential. You will immediately notify Cabbooks of any unauthorised use of your password or any other breach of security.
When accessing and using the Website you must not:
- attempt to undermine the security or integrity of Cabbooks’ computing systems or networks, or the Website;
- use, or misuse, the Website in any way which may impair its functionality, or impair the ability of any other user to use it;
- attempt to gain unauthorised access to the computer systems on which the Website is hosted, or to any materials you have not been given express permission to access;
- attempt to transmit or input into the Website any files that may damage any other person’s devices or software, content that may be offensive, or material or Data in violation of any law;
- attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer the Service, Website or any software included in it;
- access the Website other than manually — automated agents, robots or scraping software (other than search engine spiders) are forbidden;
- attempt to build a copy of our Data.
Intellectual property rights
All Intellectual Property Rights in all the material which comprises the Website, including but not limited to design, structure, layout, graphical images and underlying source code, belong to Cabbooks. All rights are reserved.
You acknowledge that, except as otherwise agreed between the parties in writing, all Intellectual Property Rights in Cabbooks and the Website shall remain with Cabbooks.
Trademark notice
Cabbooks and the Cabbooks logo are trademarks of Cabbooks Limited.
Disclaimer of warranties
You acknowledge that:
- you are authorised to access and use the Website;
- the Website is provided on an “as is, where is” basis and at your own risk;
- Cabbooks does not guarantee the availability of the Website and does not warrant that its use will be uninterrupted, timely or error-free. The systems used to access the Website, including the internet, can be unpredictable and may from time to time prevent access to it; Cabbooks is not responsible for any such interference;
- Cabbooks is not your accountant or tax adviser, and use of the Website should not substitute professional accounting or tax advice. If you have accounting or tax questions, contact an accountant;
- it is your sole responsibility to determine that the Website meets the needs of your business, and Cabbooks makes no warranty that it does;
- you remain solely responsible for complying with all applicable tax, accounting and other laws, including any laws requiring you to retain records. It is your responsibility to check that storing and accessing your Data via the Website complies with laws applicable to you;
- Cabbooks reserves the right to revise, change, modify, delete or suspend any part of the Website or the Service it provides, without notice, at any time.
Cabbooks gives no warranty about the Website or Service, including as to its accuracy, reliability, adequacy or completeness. To the extent permitted by law, all implied conditions or warranties are excluded, including warranties of merchantability, fitness for purpose, and non-infringement.
The service
Cabbooks is bookkeeping and Making Tax Digital for Income Tax software for self-employed taxi drivers. Cabbooks is not HMRC, and using Cabbooks is not a substitute for professional accounting or tax advice.
When you send a quarterly update or agree to a final declaration through Cabbooks, that submission is made to HMRC on your explicit instruction. Cabbooks prepares and transmits it on your behalf, but the decision to submit, and responsibility for what is submitted, is yours.
Your account
You must be an adult, genuinely self-employed, and eligible to register for Making Tax Digital for Income Tax to use Cabbooks. See “Access conditions” above for your responsibility to keep your login secure.
Your data
See our Privacy Policy for what personal data we collect and why. You can export a full copy of your data, or delete your account and all associated data, at any time from Settings.
Fees
Cabbooks is a paid subscription service. Subscription fees, and how they are billed, will be published on our pricing page. By subscribing, you agree to pay the fees in place at the time you sign up.
Accuracy and liability
That tax figures shown in Cabbooks are estimates, that you are responsible for what you send to HMRC, and the limits of our liability if something goes wrong.
Cancelling
You can cancel your subscription at any time from your account settings. Cabbooks will not accept instructions to cancel on your behalf, to protect against fraudulent cancellation requests. When your account is cancelled, your data is deleted — you can export a full copy of your data first from Settings.
Termination and remedies
Cabbooks may restrict, suspend or terminate your subscription, or deny you access to the Website, without notice, in its sole discretion.
Cabbooks will disclose your identity and account details if required by a court order or requested by a law enforcement authority.
Support
Cabbooks aims to respond to support queries as quickly as reasonably possible, but does not guarantee a specific response time.
Support is not intended to deal with questions relating to accountancy, taxation or company law. Cabbooks will only help you learn how to use the Service.
Support is intended to provide timely, informal help, and any reliance placed on it is at your own risk. Any opinions or statements made through support should be checked with a relevant professional. To the fullest extent permitted by law, Cabbooks does not accept responsibility for opinions or statements made in the course of providing support.
You agree that Cabbooks may access your Data for legitimate purposes, such as to assist you with a support query or to investigate and resolve an issue you have raised.
Cabbooks reserves the right to withdraw support if you send malicious, offensive or illegal support requests.
Indemnity
You indemnify Cabbooks against all claims, costs, damage and loss arising from your breach of these Terms or any obligation you may have to Cabbooks, including but not limited to any costs relating to the recovery of any Subscription Fee that you have not paid.
Data ownership
The Data you input into Cabbooks belongs to you.
Access to your Data is contingent on full payment of the Subscription Fee when due. You grant Cabbooks a licence to use, copy, transmit, store and back up your Data for the purposes of providing you the Service.
You must keep your own copies of all data you input into the Website. Cabbooks takes reasonable steps to prevent data loss, including regular backups, but does not guarantee that no data loss will occur, and excludes liability for any loss of data however caused.
Force majeure and delays
Neither party is liable for any delay or failure in meeting its obligations under these Terms due to any cause outside its reasonable control, including acts of god, riot, war, malicious damage, fire, electricity supply failure, or government authority. This does not excuse either party from any obligation to pay money.
Severability
Should any provision of these Terms be held void, invalid, unenforceable or illegal by a court, the validity and enforceability of the other provisions will not be affected. If any provision is found unenforceable, you agree to a modification of that provision to preserve its intent, to the extent permitted by law.
Absence of waiver
Any failure or delay by Cabbooks to enforce any of these Terms, or to exercise any right under them, will not be construed as a waiver of that right.
Right to assign
Cabbooks may assign its rights and obligations under these Terms, and on such assignment will be relieved of any further obligation under them. You may not assign or transfer any of your rights or obligations to any other person without Cabbooks’ prior written consent.
Entire agreement
These Terms and the Privacy Policy supersede all prior agreements, representations (whether oral or written) and understandings, and constitute the entire agreement between you and Cabbooks.
Rights of third parties
A person who is not a party to these Terms has no right to benefit under, or to enforce, any term of these Terms.
Notices
Any notice given under these Terms by either party to the other must be by email, and will be treated as given on transmission. Notices to Cabbooks must be sent to hello@cabbooks.online. Notices to you will be sent to the email address you provided when setting up your account.
Changes to these terms
Cabbooks may update these Terms from time to time. If we make a material change, we will let you know, for example by email or a notice on the site. Continuing to use Cabbooks after a change takes effect means you accept the updated Terms.
Governing law
Your use of the Website and Service, and these Terms, are governed by the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the English courts.
